SALE legal fees and disbursements including VAT

(our fixed fees include reviewing the deeds to your property, drafting Contract documentation and sending supporting documents, responding to enquiries raised by the purchaser(s) solicitors, approving Transfer documentation, acquiring a redemption statement for your mortgage (if you have one), keeping your estate agent up to date, preparing a completion statement and settling the estate agent fees, redeeming the mortgage (if you have one) and sending any balance sale proceeds to you. PURCHASE legal fees and disbursements including VAT

(our fixed fees include reviewing the title and deeds to the property, approving Contract documentation, investigating the title to the property, raising enquiries to the seller(s) solicitors, preparing Transfer documentation, reviewing your mortgage offer and advising you of the terms and conditions  (if you acquire one), keeping the estate agent up to date, preparing a completion statement, applying for the mortgage monies in good time for completion  (if you acquire one) and advising you of any monies required of you for completion. For properties above £925,000 our legal fees will be at a rate of 0.7% plus VAT

HMRC Stamp Duty Land Tax will be payable dependent upon your circumstances for example, if you are first time buyer, whether the property is to be a ‘second home’ etc. You can check using the HMRC online Stamp Duty Land Tax calculator https://www.tax.service.gov.uk/calculate-stamp-duty-land-tax/#!/intro
Please note we do not charge an additional fee for processing a Stamp Duty Land Tax Return on your behalf if we have your authority to do so.
We also do not charge to process the release of monies from Help to Buy ISAs and can support the release monies from Lifetime ISAs. You should contact your product provider to check how many days’ notice is required in order for monies to be released as these can differ significantly.

 

If you wish to transfer your property to another or include someone else on your title our fixed fee will be £300 plus VAT. There are no disbursements if it is a gift otherwise the Land Registration fee will be based on the value of the property.

If you wish to re-mortgage your property our fixed fee is £600 plus VAT. Searches will be approximately £350 depending upon the area and the Land Registration fee will be based on the value of the property.

Occasionally, a sale or purchase transaction may not proceed for example due to an unsatisfactory survey or broken chain- there is no legal commitment to the transaction until Contracts are exchanged. Whatever the reason, if a transaction is aborted, WE WILL NOT CHARGE OUR CLIENTS FOR OUR FEES- ONLY INCURRED DISBURSEMENTS (e.g. searches). Full information on our offer can be found below:-

No Exchange No Fee

The company we use to provide our searches of properties, namely Brighter Law, also offer a ‘SEARCH FEE GUARANTEE’. This means that if your purchase does not proceed to exchange of contracts once your searches have been ordered, you will entitled to a SECOND SEARCH PACK FREE IF YOU FIND A SUBSEQUENT PROPERTY TO PURCHASE WITHIN SIX MONTHS.

Conveyancing describes the process by which legal ownership of a property is transferred from one owner to another.

Sellers will find ‘The Law Society- Your guide to Buying a home’ a useful read as it summarises most of the stages for them too. Essentially the buyer’s solicitor/conveyancer will investigate the title on their behalf and the seller’s solicitor/conveyancer will provide evidence of the title and respond to any enquiries on their behalf.

How long will it take?

Understandably, clients often ask how long it will take for a sale or a purchase transaction to complete.

Transactions usually complete within 6-8 weeks though it does depend on how each of the stages go throughout the process and whether there is a chain of linked transactions. Communication between the parties solicitor/conveyancer is essential as is our communication with you to ensure that you are fully informed throughout the transaction.
